County Official Arrested with .000 BAC

Gwinnett County (Georgia) Commissioner Charles Bannister was arrested for DUI late last month, despite the fact that his breath tests showed he had no alcohol in his system.  The sheriff's department has since dropped the charges, fully exonerating Mr. Bannister, and apologizing for the mistake.

A sheriff's deputy, responding to tips, watched Mr. Bannister leave a restaurant; he claims Mr. Bannister drove off and nearly caused an accident after weaving from side-to-side, as reported by the Atlanta Journal-Constitution.  The deputy claims he smelled alcohol on Mr. Bannister's breath and administered 3 field sobriety tests, which he says Mr. Bannister failed.  Later tests confirmed Mr. Bannister's BAC was .000.
