DWI Charge for NY Officer Who Killed Pedestrian & Refused Breath Test

A New York police officer charged with DWI and Vehicular Manslaughter after he struck and killed a pedestrian with his vehicle is now trying to turn the focus onto the victim, a pastor's daughter.  He claims she was drunk and wandered into traffic.

The officer reportedly reeked of alcohol and seemed to be drunk, and cups were found in and around his vehicle.  He also allegedly refused a breath test.
