Fairfax County drivers beware! Police have started an aggressive campaign against texting while driving.
While Virginia is one of 30 states that bans texting while driving, it is finding it difficult to enforce, for two main reasons. One, it is difficult to distinguish texting (illegal) from dialing a phone number (legal); and two, texting while driving is a secondary offense, meaning you must be stopped for something else (a primary offense).
Fairfax County police have compensated by charging distracted drivers (not just texters) with failure to pay full time and attention. The fine is slightly higher, but police have more latitude when issuing this citation.
