Fairfax County Judge Criticizes Texting While Driving Law

Last month, Fairfax County Judge Thomas E. Gallahue dismissed a reckless driving charge against a defendant who killed a college student, allegedly because he was texting while driving.  The Washington Post reported that Gallahue said, "“I think you are driving recklessly,but the [Virginia] legislature has said texting is something way less than that,” referring to the 2009 law making texting while driving a "a minor traffic infraction punishable by a maximum fine of $20."
