Lawyer Argues DUI Law Doesn't Apply to Private Property
Posted on Oct 03, 2013
A lawyer in Georgia made an interesting argument in the DUI case he was defending: he said his client shouldn't have been charged with DUI because she was on private property in a gated community. He argued that if a traffic law is broken on such properties, the police don't get involved, that "whatever security force patrols the property" takes action. Unfortunately for his 19 year-old client whose BAC was .20, the judge didn't buy it, and said DUI laws apply everywhere, private property or not.
