Marijuana Case Tossed After Officer Lies on the Stand

A marijuana case in Philadelphia has been thrown out after the arresting officer perjured himself. Just after the officer testified about the details of the traffic stop and subsequent search of the defendant and his vehicle, the defense attorney played a surveillance video that showed that the officer's testimony was not true. He did not, for instance, have a conversation with the defendant before searching him and his passenger. He also did not, as he had testified, waited for a warrant before searching the defendant's trunk. Perhaps most disturbing is the fact that a supervising officer was on the scene when the illegal search took place. This case illustrates what most defense attorneys already know - that police don't always tell the whole truth on the stand.
