Police Officer Charged with DWI and Refusal Loses Drivers License

An Albany police officer lost his drivers license early last month after a DMV hearing was held because he refused a chemical breath test after his DWI arrest last December. Brian Lutz, 40, was arrested after a patrolman responded to a report of a vehicle stopped in a lane on I-787. Mr. Lutz appeared to be asleep, and there was vomit outside the open driver's door. He failed several field sobriety tests, and registered a BAC of .21 percent an alcohol pre-screening device. He later refused a chemical breath test at the police station. His trial date has not yet been set.
