Virginia Judge Rules on "Accidental Sex"

This a bizarre ruling in a divorce case. The judge decided that the parties had not reconciled their marriage, in spite of the fact that they had sex during the period of the separation. According to the husband, that was just "accidental sex" and it had nothing to do with the fact that they were legally married (huh?). The judge accepted that, and found that the separation period has run un-interrupted. Hard to follow, but I can infer that the wife may have felt differently, because somebody had to be opposing this or it shouldn't be decided by a Judge. No surprise, both parties are Virginia Attorneys. "Ouch!".
