Do I have to post bail after being arrested for DUI?

For most routine cases of DUI in Fairfax County Virginia, the magistrate will allow a person to be released on their own recognizance.  That is a promise to appear, subject to a penalty if you breach the promise.  For serious cases such as 2nd offense or multiple counts, and for out-of-state residents, they may require that you post bond, either cash or using a bonding company.
