If my BAC is under .08, can I still be charged with DUI?

Yes, I have seen DWI charges in Fairfax County against people with BAC's as low as .05, especially if there was an accident or bad field sobriety tests.  As an alternative, the cops and magistrate might write the charge as Reckless Driving, but we usually hope to fight those charges if there is no actual bad driving involved.
